1. Acceptance of these Terms
By accessing or using silverkeypropertymanagement.com (the “Website”), you agree to these Terms of Use (the “Terms”). If you do not agree, you must stop using the Website.
The Website is operated by Silver Key Property Management (“we,” “us,” “our”), a property management company operating in Manitoba, Canada. Silver Key Property Management is a sole proprietorship operating under Crocus Real Estate Ltd.
Effective Date: October 9, 2026.
Last Updated: October 9, 2026.
How these Terms fit with other documents and the law. These Terms govern your use of the Website only. They do not replace, amend, or override any lease, tenancy agreement, property management agreement, rental application, consent form, privacy notice, or other agreement or notice that governs a separate relationship with us. Where these Terms conflict with a separate agreement, that agreement governs the subject it specifically addresses.
Everything in these Terms applies only to the extent permitted by applicable law. Nothing in these Terms excludes, limits, or waives any right, remedy, or obligation that cannot lawfully be excluded, limited, or waived, including under consumer protection, residential tenancy, and privacy laws.
2. About this Website
The Website provides information about Silver Key Property Management and our property management services, and lets visitors contact us and submit information through website forms. It is intended mainly for information and communication. It does not currently provide user accounts, online payments, or a way for visitors to publish content. If those features are added, we may update these Terms to address them.
Website content is general information only and is not legal, financial, tax, or other professional advice. Using the Website, submitting a general inquiry, or communicating with us through it does not by itself create a tenancy, a property management relationship, or any other contractual relationship with us. Any such relationship arises only under a written agreement and applicable law.
3. Using the Website and acceptable use
You may use the Website for lawful personal or business purposes related to our services. When using it, you agree not to:
- violate any law or regulation, or infringe the rights of another person or organization;
- submit information you know to be false, misleading, fraudulent, or unauthorized, or impersonate another person;
- send spam, malware, or any unlawful, threatening, harassing, or discriminatory material;
- use bots, scrapers, or other automated tools to collect Website content or data without our authorization, except for ordinary search-engine indexing or other access the law permits;
- try to gain unauthorized access to the Website, its systems, or other people’s information, or bypass its security measures;
- conduct unauthorized security testing, scanning, or probing, or interfere with, disrupt, damage, or overload the Website; or
- use the Website to distribute unsolicited advertising or promotional material.
Nothing in this section prohibits lawful complaints, legitimate criticism, or ordinary communications with us. We may take reasonable steps to investigate suspected misuse and to protect the Website and its users.
4. Property information, inquiries and forms
Property information. Listings, descriptions, photographs, floor plans, measurements, rental rates, availability, maps, and other property content are for general information. They may change, become outdated, or contain errors or omissions, and photographs, floor plans, and measurements may not reflect current conditions or exact dimensions. Confirm details with us before relying on them. Nothing on the Website is an offer to rent, a guarantee that a property is available, or a guarantee that an application will be accepted. Rental terms are set by the signed tenancy agreement and applicable law.
Inquiries and applications. Submitting a contact form, sending an email, or otherwise contacting us through the Website does not by itself create a tenancy, accept a rental application, or establish a property management agreement. A general inquiry is not a formal rental application; if we provide a dedicated application form or process, the instructions and notices that come with it apply. We may respond to general inquiries at our discretion and as reasonably practicable.
Sensitive information. Please do not submit Social Insurance Numbers, banking details, copies of government identification, or other sensitive information through general Website contact forms or by unsolicited email. Provide it only when we ask for it and in the way we direct, such as an approved application process, in person, or by email where we specifically request it. Information sent electronically may be exposed to risks outside our control. How we handle personal information is described in our Privacy Policy, including Section 17, Cookie Policy.
Accuracy and authorization. You agree to provide accurate information, not to knowingly submit false, misleading, or unauthorized information, and to have the authority or other lawful basis to provide any information you submit, including information about other people.
Emergencies. Website forms and general email are not monitored continuously and may not be reviewed immediately. Do not use them to report an emergency or an urgent maintenance issue. Tenants should follow the emergency and maintenance reporting procedures provided for their property. In an immediate emergency, contact emergency services.
Electronic submissions. You are responsible for providing accurate contact information when you submit a form. Electronic submissions and responses may be delayed, filtered, or unsuccessful, so use another contact method if a matter is urgent or needs confirmation. An automated confirmation does not by itself mean we have accepted a rental application, approved a tenancy, entered into an agreement, or agreed to perform a service.
5. Intellectual property
The content of the Website, including text, photographs, graphics, logos, layout, and design, is owned by or licensed to Silver Key Property Management and is protected by Canadian and international copyright, trademark, and other intellectual property laws.
You may view the Website, print or save pages for your own personal, non-commercial use, and share links to publicly accessible pages. Except as permitted by law or with our written permission, you may not reproduce, republish, modify, distribute, commercially exploit, or create derivative works from Website content, or use our name or logo in a way that suggests authorization or endorsement.
Content owned by third parties remains the property of its owners and may be subject to separate licence terms. All rights not expressly granted are reserved.
6. Third-party links and services
The Website may link to or embed third-party websites and services, such as Google Maps, hosting and technology providers, analytics, form-processing, and spam-prevention tools. We do not control independently operated services and are not responsible for their content, availability, security, or privacy practices, and a link is not an endorsement. Your use of a third-party service is governed by that provider’s own terms and policies, and it may collect information directly from you. Our use of third-party services is described further in our Privacy Policy, including Sections 7, 8, 14, and 17.
7. Privacy and cookies
How we collect, use, share, retain, and protect personal information, including through cookies and similar technologies, is described in our Privacy Policy, which includes Section 17, Cookie Policy. Please review it for details about third-party processing and your choices. These Terms and the Privacy Policy should be read together.
The Website uses embedded Google Maps. As the Privacy Policy explains, Google may receive technical information from your browser or device when a page with an embedded map loads, and the map may load before you make a choice in the cookie banner. The cookie consent tool does not necessarily control every third-party technology or embedded service.
Using the Website does not replace any consent that must be obtained separately under applicable privacy laws. Where consent is required, we will obtain it through the applicable form, notice, or consent mechanism.
8. Disclaimers
The Website and its content are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, conditions, and representations of any kind, express or implied, including any about merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. We do not warrant that the Website will be available, uninterrupted, secure, accurate, complete, current, or free of errors or harmful components, or that information will be updated immediately.
We may update, correct, remove, or change Website content and functionality at any time. You are responsible for deciding whether Website information is suitable for your purposes and for confirming material details with us before relying on them. You use the Website at your own risk.
9. Limitation of liability
To the fullest extent permitted by applicable law, Silver Key Property Management and its owners, directors, officers, employees, agents, affiliates, and service providers (together, the “Protected Parties”) are not liable for any damages or losses of any kind arising from or related to your use of, or inability to use, the Website or your reliance on its content. This includes direct, indirect, incidental, special, consequential, exemplary, and punitive damages, and loss of profits, revenue, data, goodwill, or business opportunities. It applies whatever the legal theory, including contract, negligence or other tort, or statute, and even if we were told such loss was possible.
These limits apply to the extent they are enforceable and do not limit liability that cannot lawfully be limited. They do not replace the terms of any separate written agreement for services, which govern claims about those services.
10. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Protected Parties from third-party claims, losses, liabilities, damages, and reasonable legal costs arising from or related to:
- your use or misuse of the Website;
- your breach of these Terms;
- your violation of any law, or your infringement of another person’s intellectual property, privacy, or other rights; or
- information you submit through the Website that is unlawful or that you are not authorized to provide.
You are not required to indemnify a Protected Party for losses caused by that party’s own wilful misconduct or gross negligence, or where indemnification cannot lawfully be required.
11. Access restrictions and termination
We may restrict, suspend, or terminate access to the Website, in whole or in part, at any time, with or without notice, including where we reasonably believe there is misuse, a security threat, unauthorized access, unlawful activity, or a breach of these Terms. We may also modify, suspend, or discontinue any feature of the Website at any time. To the fullest extent permitted by law, the Protected Parties are not liable for doing so.
Restricting Website access does not by itself end or change a tenancy, property management agreement, or other separate relationship with us.
12. Changes to these Terms
We may update these Terms from time to time to reflect changes in our business, the Website, technology, or the law. The “Last Updated” date at the top shows when they were most recently revised, and the current version is posted on the Website. Changes take effect when posted.
By continuing to use the Website after changes take effect, you accept the updated Terms, except where applicable law requires additional notice or a separate acceptance. In that case we will give the notice or obtain the acceptance the law requires. Changes do not amend any separate written agreement. If you do not agree with the revised Terms, you must stop using the Website.
13. Governing law and disputes
These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada that apply in Manitoba, without regard to conflict-of-laws rules.
If you have a concern about the Website, please contact us first so we can try to resolve it informally. Any dispute that cannot be resolved that way will be brought in the courts of Manitoba, and you and we agree to submit to their jurisdiction. This does not limit any right you have to bring a matter before a tribunal or regulator, such as the Residential Tenancies Branch or the Office of the Privacy Commissioner of Canada.
14. General provisions and contact information
Entire agreement. These Terms, together with the Privacy Policy (including Section 17, Cookie Policy), are the entire agreement between you and us about your use of the Website. They do not replace any separate agreement, as described in Section 1.
Severability. If any part of these Terms is found to be unenforceable, the rest remains in effect.
No waiver. If we do not enforce a right under these Terms, that does not mean we give it up.
Language and translation. These Terms are published in English. Browser or third-party translations may contain errors or differences in meaning, and we do not control their accuracy. If a translation differs from the English version, the English version is the reference version, subject to applicable law and any mandatory language requirements.
Contact us. Questions or concerns about these Terms can be sent to the address below. Formal legal notices may be subject to separate delivery requirements under applicable law or a separate agreement, and a message sent through a general Website form or ordinary email does not necessarily satisfy them.
